Most people assume that when they sell through a platform, the platform's authority ends at the platform's edge. The commission applies to sales on that platform. The rules apply to conduct on that platform. What you do on your own website, in your own studio, through your own channels, is your own business.

What does the price parity clause say?
From the Bluethumb Membership Agreement:
"All artwork prices displayed on Bluethumb must be equal to, or lower than artwork offered for sale elsewhere. This means Artists explicitly agree to not price artwork listed on Bluethumb at a lower price on personal websites, exhibitions, other online galleries marketplaces (including online discounts and sales)."

Your Bluethumb price must be equal to or lower than your price everywhere else. That means you cannot charge less on your own website than you charge on Bluethumb. You cannot run a sale through your own mailing list without running the same sale on Bluethumb. You cannot offer a returning collector a loyalty discount through your own channels without making that discount available on the platform too.
Why does this clause exist?
It exists to protect Bluethumb's commercial position. If artists could undercut their Bluethumb prices on their own websites, collectors would go direct - they would pay less, the artist would keep more, and Bluethumb would earn nothing. The price parity clause prevents that. It keeps Bluethumb price-competitive with the artist's own channels without Bluethumb having to do anything to earn that competitiveness.
Airlines use similar clauses with booking platforms. Hotels use them with accommodation sites. The clause is legal in most contexts but it is openly understood as an anti-competitive mechanism that benefits the platform at the expense of the seller. In those industries the practice is increasingly scrutinised by regulators. In the art world it is buried in a membership agreement that most artists sign without reading.
What does this cost artists in practice?
It means your pricing strategy across every channel you sell through is constrained by a platform that takes 44% of every sale. You cannot offer a direct-purchase discount on your own website to encourage collectors to buy from you rather than through Bluethumb - because offering that discount means you also have to offer it on Bluethumb, where Bluethumb takes 44% of the discounted price.
You cannot run a studio sale. You cannot offer a mailing list exclusive. You cannot negotiate privately with a collector and accept a lower price without risking a price parity breach on your platform listing.
A platform that earns 44% of every sale you make through it has inserted itself into every commercial decision you make across your entire practice. That is not a listing agreement. It is a commercial relationship that extends well beyond the boundaries of any individual platform.
What does a fair alternative look like?
